Internet access to online policy administration system

  1. Use of System
    • You are permitted to use the system, subject to compliance at all times with these Terms and Conditions, any existing Agreement between us and all relevant statutory or regulatory requirements. We reserve the right to withdraw your right to use the system at any time, without warning or notification.
  2. System Security
    • Requests for access will not be completed until authorised by Norwich Union.
    • Access to the system is controlled by a customer account number and PIN (Personal Identification Number) being allocated to each authorised staff member.
    • You will be issued with details of your users account numbers and initial control codes. You are responsible for ensuring that the details are securely communicated to staff and that each user changes their PIN number immediately.
    • Passwords will be set initially to a control code. The user will be forced to change this to one of their own choice the next time they logon.
    • Minimum 6 characters long
    • All numeric characters but no special characters including space
    • Not consecutive numbers
    • You are responsible for ensuring that each user is aware that they must :-
    • Keep their PIN confidential
    • Not leave a PC unattended whilst connected to the system
    • Destroy or securely store any information printed off the system.
    • You are responsible for ensuring that only authorised staff have access to the system and agree to promptly notify NUI of all changes to access requirements including :-
    • Staff who no longer require system access.
    • Staff leaving/joining the company.
    • If a PC on which the system has been used is sold or permanently leaves your premises for any reason, you must securely erase all NUI information and personal data including temporary internet files.
    • User access to the system (logon/PIN) will be automatically revoked after a number of consecutive unsuccessful logon attempts.
    • Resetting of PINs for revoked or forgotten passwords will be controlled by the e-broking support team. They can be contacted on 0800 158 2224.
  3. System Availability
    • Availability of the system depends on our own systems availability and normal internet availability. We will not accept liability for unavailability of the system for any reason.
  4. Security of Data
    • You warrant to us that you have (and will maintain) appropriate security procedures to protect the data made available to you, in accordance with DPA requirements.
    • NUI accept no liability for loss or damage suffered by your company arising from any of your employees or agents.
  5. Data Protection Act
    • The data held on the system belongs to NUI. You are only authorised to use it in accordance with our instructions.
    • Data Security / Integrity
    • Before accessing the NUI system and disclosing any data to a client, you must verify your client from your companies own systems / records.
    • Your staff accessing the NUI system should have been trained on best practice in authenticating those seeking access to information from or providing transactional data to NUI systems
    • Any Subject Access Requests in respect of personal data held on the system must be sent to the Data Protection Act Manager, Norwich Union Insurance Ltd, Pitheavlis, Perth, PH2 0NH without delay.
    • Data Protection - dedicated telephone number - 01738 896543. You are required to immediately telephone this number to notify NUI of the existence of a Data Protection subject access request to enable it to be progressed.
    • Minimum data which should be provided in notifying subject access to NUI is the following:
    • Individuals name
    • Address
    • Telephone number (if available)
    • Policy number
    • Nature of any underlying complaint
    • Date request made
    • Contact point in office with whom matters can be discussed
    • Subject access fee
    • No notice or collection of subject access fees from individuals is to take place. This will be done by the NUI DPA team when verifying the client request with the individual.
    • Subject access assistance
    • You may be required to provide assistance to help us satisfy any subject access. Assistance may be required on data extraction, interpretation and provision of a contact point responsible for Data Protection compliance.
    • Data Migration
    • No migration of data should occur from the NUI system to your own system unless prior authorisation has been obtained from NUI.
    • We will monitor the use of the system and retain information identifying the Intermediary, time of use and accesses made. This information will be used for administrative and security purposes.
    • Your company accepts liability for any loss or damage suffered by our clients as a consequence of misuse of any information or personal data obtained from the PIN protected system and used in any manner not supported by any written instructions issued or authorised by NUI.
  6. Revoking Access
    • If your organisation ceases to have an agreement with us for the provision of services to us (or our customers) we will revoke authority to access the system for all your users.
  7. Indemnity
    • You agree to indemnify us against any claim, demand or action and any damages, fines, costs or expenses we may incur as a result of any alleged breach of confidentiality or of the Data Protection Act 1998 (or subsequent legislation) arising from the misuse by you, your agents or employees of data we have made available to you or members of your organisation under the system.
  8. Audit
    • All books, documents, and any messages or other data held on electronic media belonging to NUI and held by you shall be available at all times to NUI or NUI's professional advisers or HM Customs and Excise for inspection. You shall provide copies of any such records to NUI or HM Customs and Excise on request.
  9. Liability
    • You are responsible for the accuracy of all data input or processed by you, your agents or employees.
    • You will indemnify NUI for any loss, penalty or damage sustained by NUI resulting from any misuse or corruption of, unauthorised access to, use of or additions or alterations to any data, or any failure to keep the data up to date.
    • If you become aware of any misuse or corruption of data etc as set out in previous point, you must notify NUI immediately.
    • NUI will not be liable for any loss or damage suffered by you as a result of any delay in relaying data to yourselves where such delay is beyond the control of NUI, its employees or agents.
    • DVLA have advised us that unless motor certificates are downloaded and printed by duly authorised agents, electronic certificates do not comply with the current legislation and are not acceptable for vehicle licensing purposes.
  10. Termination
    • This agreement will automatically terminate in the event of termination of your existing Agency with NUI or if NUI withdraws your authority to use the system.
    • Upon termination of contract, you agree to securely erase any information or personal data which originates from your usage of the NUI system with immediate effect.
  11. Existing Agreement
    • These terms and conditions are in addition to any existing Agreement between us (and any amended or subsequent version thereof).
    • Please note that the following terms and conditions must be agreed to before e-service access will be provided.
